This naming refers to the ideas of both parties about the Adel in views of his just and impartial disposition. The Adel can be natural or incorporeal personality.

1. The Adel shall take possession of the mortgaged     property. From the Islamic point of view, this     possession is divided into two parts: actual possession,     meaning that the acquisition of the property and     assumed possession is based on procedures that     prevent the Adel from disposing of the mortgaged     property and gives the creditor the opportunity to     execute a sale of the property if the right conditions     are met.
